1.1 You decide what is uploaded to Trine, who uploads it, and whether it is correct.
1.2 We do not check, verify, validate or authenticate uploaded records. We do not confirm that a certificate is genuine, that a policy is current, that a DBS check was properly obtained, that a training record reflects training actually delivered, or that a risk assessment is adequate.
2.1 Trine displays statuses, expiry dates, reminders, completion counts and mappings between records and regulatory requirements.
2.2 These are derived mechanically from what you have entered. A record shown as current means a record exists and its recorded expiry date has not passed. It does not mean the record is accurate, adequate or sufficient.
2.3 A mapping between a record and a regulatory requirement indicates where that record would typically be relevant. It is not an assessment that you meet that requirement.
2.4 A complete or green status anywhere in Trine is not a statement of compliance, and must not be presented to a regulator, commissioner or inspector as one.
3.1 You remain solely responsible for compliance with the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014, the CQC's fundamental standards, and all other regulatory, statutory and contractual obligations that apply to your service.
3.2 You remain responsible for all notifications to the Care Quality Commission, for safeguarding referrals, and for any statutory reporting. Where Trine records that a notification was made, that record is evidence of your entry, not evidence that the notification was submitted or received.
3.3 Trine does not provide regulatory, legal, clinical or professional advice.
4.1 You confirm that you have the right to upload the records you place in Trine, and a lawful basis for doing so.
4.2 Where records contain special category data or criminal offence data, including health information about staff or residents and DBS outcomes, you confirm that you have identified the appropriate Article 9 or Article 10 condition and that you have given the required privacy information to the individuals concerned.
4.3 You must not upload records that you are not permitted to disclose to a processor.
5.1 Trine provides template documents, policy skeletons and a routine-check library.
5.2 These are starting points based on common practice. They are not tailored to your service and have not been reviewed for your circumstances.
5.3 You are responsible for reviewing, adapting and approving any template before relying on it. Using a template unchanged does not transfer responsibility for its content to us.
By accepting, you confirm on behalf of the Provider that you have read and understood this statement, that responsibility for the accuracy and adequacy of uploaded records rests with the Provider, and that Trine is a record-keeping tool rather than a guarantee, assessment or certification of compliance.
